Who qualifies

  • Vietnamese citizens with full civil capacity may set up a household business; a foreign national registers a company instead (Decree 168/2025, Article 82).
  • The host must meet the security-and-order, fire-safety, environmental and food-safety conditions of Article 49 of the Law on Tourism.
  • Minimum facilities depend on the type: for a home with rooms to let, a guest sleeping area, kitchen, bathroom and toilet, and bedding.
  • A flat in a residential apartment block may be run as lodging only where the block's approved design and the local rules allow it (see the building rules).

How to apply

  1. Register the business: a household business at the commune-level business registration office, or a company through the national Business Registration Portal (dangkykinhdoanh.gov.vn).
  2. Meet the security-and-order and fire-safety conditions and, where it applies, apply for the police certificate of eligibility for security and order (dichvucong.bocongan.gov.vn).
  3. At least 15 days before opening, send a written notice to the provincial Department of Culture, Sports and Tourism with the name, type and scale of the accommodation, its address, the legal representative and a commitment that the Article 49 conditions are met.
  4. Register for a tax code and file returns on the General Department of Taxation e-tax portal (thuedientu.gdt.gov.vn).
  5. Report each guest to the police or residence registration authority before 23:00 on the day the stay starts.

FAQ

Vietnam Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Vietnam?

Yes, for registered hosts. Tourist accommodation needs a business registration, compliance with security-and-order and fire-safety conditions, and a written notice to the provincial tourism department 15 days before opening.1,14

Do I need a permit or licence for Airbnb in Vietnam?

There is no Airbnb-specific licence. A host needs a business registration (a household business for Vietnamese citizens, a company for foreign nationals) and sends the 15-day opening notice to the Department of Culture, Sports and Tourism.1,10,14

How much does the licence cost?

The annual business licence fee (lệ phí môn bài) ended on 1 January 2026, so none is payable for 2026 or later years. Article 29 of Decree 168/2017, which sets the opening notice, lists no fee for it.2,20

Can I rent out a home I don't live in?

Yes, as a registered accommodation business. A house or villa follows the registration and 15-day notice rules, while a flat in a residential block is the riskiest case because the Housing Law forbids non-residential use of apartments.1,6,21

Is there a limit on nights per year or a minimum stay?

No national limit exists. The Ministry of Justice said in May 2025 that no rule defines how many days make a short let, although the Ministry of Construction reads the apartment ban as covering short stays.21

Can I list my apartment on Airbnb?

In an apartment block the Housing Law bans use of a flat other than for living, and the Ministry of Construction treats paid short stays as such use. In Ho Chi Minh City, a tourist apartment in a block must be registered as tourist accommodation (Decision 19/2026, from 25 April 2026).6,7,21

Do I have to report my guests to the police?

Yes. Notify the residence registration authority before 23:00 on the day the stay starts, or before 08:00 the next day after a late arrival. Foreign guests are reported through the immigration portal.3,23

What is the fine for hosting without registration?

Failing the business-registration or safety conditions is fined VND 20 million to 30 million for an individual, double for an organisation, with a 1 to 3 month suspension. Skipping the opening notice is VND 1 million to 3 million.15

What is the fine for not reporting guests?

Decree 282/2025, in force from 15 December 2025, fines an individual VND 2 million to 4 million for 1 to 3 guests, VND 4 million to 8 million for 4 to 8 guests and VND 8 million to 12 million for 9 or more; organisations pay double.16

Does Airbnb collect VAT in Vietnam?

Vietnamese law requires platforms with payment functions, foreign ones included, to withhold VAT at 5% on bookings by household and individual hosts (Decree 117/2025). Airbnb's Vietnam help page still tells hosts to register for VAT themselves.5,11,23

Do small hosts pay VAT?

Not up to VND 1 billion of revenue a year: households and individuals below that threshold are outside VAT, and tax withheld by a platform is refunded if the year ends at or below it. Above it VAT is a percentage of revenue; a company host charges the standard rate, 8% to 31 December 2026 and 10% from 1 January 2027.4,11,18,19

Can a foreigner host on Airbnb in Vietnam?

Household-business registration is open to Vietnamese citizens, so a foreign national who wants to run lodging registers a company.10,23

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. Statutes and decisions on thuvienphapluat.vn were read from Internet Archive copies (Law on Tourism, Decrees 168/2017, 45/2019 and 282/2025, Law 118/2025, VAT Law), or in a browser where a script cannot read the site (Housing Law, Decrees 68/2026, 117/2025, 168/2025, 96/2016 and 141/2026, Ho Chi Minh City Decision 19/2026, Khánh Hòa Decision 620/2026, Hà Nội Decision 469/2022).

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
