Your home
Can You Host an Airbnb in Barcelona? It Depends on the Home
Whether you can host in Barcelona turns on whose home it is and whether you live there.
The home you live in, rented whole while you are away
Not allowedRenting a whole home to tourists for 31 days or fewer needs a HUT licence for that dwelling, and the city's definition of a HUT makes no exception for the owner's main home. It is legal only if the home already holds a Barcelona HUT licence, which is due to end in November 2028.12,23,24
A place you rent as a tenant
Not allowedThe Generalitat says the holder of a HUT is the owner who holds the municipal licence, and the city's definition covers homes that tenants or owners let to tourists. No new licences are being created, so a tenant can only operate in a flat that is already licensed.13,23,28
A flat in a building with a community of owners (comunidad de propietarios)
Allowed with conditionsSince April 3, 2025 the community's prior express approval is needed to start tourist rentals, and a vote of three-fifths of owners holding three-fifths of shares can limit or prohibit them, without retroactive effect. The flat must also hold the HUT licence.3,23
Stays of more than 31 days (any home)
Allowed with conditionsA HUT is defined as a stay of 31 days or fewer, and the city has said longer lets are governed by the Civil Code and the Urban Leases Act (LAU), not the tourist rules. The city made that statement in 2021 about room rentals. Royal Decree-law 29/2026 (in force since October 8, 2026, awaiting validation) now requires a temporary lease to state a real reason for the tenant's temporary stay and to run more than 31 days and, as a rule, no more than 12 months; without that reason it counts as an ordinary residential lease.10,23,25
Permit
Do You Need a Permit for Airbnb in Barcelona?
Yes. Short-term rental hosts in Barcelona need the tourist-use dwelling licence and Catalan tourism register number from Ajuntament de Barcelona (urban licence for the tourist-use dwelling); Generalitat de Catalunya, Catalan Tourism Register (registration number). It costs €227.1,11,12,23,24,28
- Who needs it
- Any owner or tenant who lets a whole dwelling to tourists for stays of 31 days or fewer in Barcelona.1,11,12,23,24,28
- Issued by
- Ajuntament de Barcelona (urban licence for the tourist-use dwelling); Generalitat de Catalunya, Catalan Tourism Register (registration number)
- Valid for
- Decree-law 3/2023 licences last five years. For Barcelona's existing HUTs the transition ends in November 2028 (five years from the decree-law's entry into force on November 9, 2023), unless the holder gets the single extension of up to five more years that the decree-law allows.
- On listings
- The number must appear on every listing
- Platform checks
- Spanish rules require platforms to send listing data to the national one-stop shop (kept by the Supreme Court in May 2026), and Spain's Consumer Ministry ordered Airbnb to remove 65,935 listings that lacked a valid licence or registry number (2025).
Fees
| Fee | Amount |
|---|---|
| Licence processing feeMunicipal fee for processing a tourist-use dwelling licence under decree-law 3/2023 (Ordenança fiscal 3.3, item 2.6). The city issues no new licences, so the fee is a fixed €227 only on paper. | €227 |
Who qualifies
- The dwelling must already hold a Barcelona HUT licence: the city's tourist-accommodation plan sets zero growth in tourist flats, and the city plans not to renew licences when the transition ends in November 2028.
- Whole dwelling only: a HUT is let in its entirety and its use cannot be shared with other groups.
- Habitability certificate (cèdula d'habitabilitat) required; guests may not exceed the number of people the certificate allows.
- A telephone line available 24 hours a day for guests' and neighbours' incidents.
- Under decree-law 3/2023 a HUT licence lasts five years, can be renewed only if planning allows it, and the number of HUTs cannot exceed 10 per 100 inhabitants.
Permit rules
- A tourist flat needs a HUT licence
- Renting a whole home to tourists in Barcelona needs a tourist-use dwelling (HUT) licence from the city. Without one the rental is illegal.1,23 In force since November 9, 2023
- The city says it will not create new HUT licences
- Barcelona says that under decree-law 3/2023 the current licences end within four years of its announcement and that the city will not create new ones. The homes are meant to return to the residential market.13 In force since June 21, 2024
- Existing HUT licences are due to end in November 2028
- Decree-law 3/2023 gave existing HUTs five years from November 9, 2023 to get the new urban licence or stop, and licences can be renewed only if planning allows it. Barcelona says it will not renew its roughly 10,000 licences, so they are due to lapse in November 2028.1,12,13,26 Takes effect November 2028
- One extension of up to five more years can be requested
- The decree-law lets a HUT holder ask the city for a single extension of the transition of up to five more years, once four years have passed and before the transition ends, by showing the transition does not compensate the loss of the licence. Barcelona says it will not renew licences.1,14 Applies to: existing licensed HUTs
- Show the Catalan register number in all advertising
- Every legal HUT has a Catalan Tourism Register number (NIRTC), and the number must appear in all advertising, promotion and marketing of the flat.28
- Poster with the number inside the flat, and give it to guests
- A poster with the register number must be displayed inside the dwelling, and the number must also be given to guests once they book.23
- Spain's national rental registry was annulled; the Catalan number still applies
- Royal Decree 1312/2024 created a Spain-wide rental registry and digital one-stop shop, with effects from July 1, 2025. On May 19, 2026 the Supreme Court (STS 620/2026) annulled the provisions creating the registry but upheld the one-stop shop and the platforms' duty to transmit data. The Catalan HUT licence and register number remain the number that matters in Barcelona.2,16,28 In force since May 19, 2026
- Airbnb has been ordered to remove listings without valid numbers
- In 2025 Spain's Consumer Ministry ordered Airbnb to remove 65,935 unlawful tourist-flat listings, mainly for showing no licence or registry number, and Airbnb removed about 65,000 by July 30, 2025. Under a July 15, 2025 agreement with the Housing Ministry Airbnb sends monthly listing data and removes listings with registry irregularities after notice; that agreement pre-dates the May 2026 Supreme Court ruling.31,32,33 Applies to: listings on Airbnb across Spain, including Barcelona · In force since May 19, 2025
Who can host
Who Can Host an Airbnb in Barcelona, and Where
Catalonia state law applies on top of Barcelona's own rules: the Catalonia short-term rental regulations page covers the state licence and what cities and counties can and can't regulate.
- Zero growth in tourist flats
- Barcelona's tourist-accommodation plan (PEUAT) sets zero growth of HUTs across the city. Zone 1 admits no new HUTs, and a HUT that closes in Zone 1, 2 or 4 can be replaced by a new one in Zone 3, up to a cap of 370; in Zone 4 (the four large transformation areas) no new HUTs are allowed.24 Applies to: whole city; zones 1 to 4 differ · In force since January 26, 2022
- The city says no HUT category will exist in its revised plan
- Barcelona announced in June 2024 that its revised tourist-accommodation plan will have no category recognising tourist-use dwellings, so the HUT licence will no longer exist.13 In force since June 21, 2024
- No tourist rentals of individual rooms
- The city has said it keeps its ban on tourist rentals of rooms for periods of 31 days or fewer, and its HUT licence covers whole homes only. Its planning rules would admit the Catalan 'llar compartida' (shared home, where the host lives in the home) only by converting an existing HUT and only under an ordinance that the plan leaves to be developed later. Rooms let for more than 31 days on ordinary long-term terms remain allowed.23,24,25,29 Applies to: tourist rentals of rooms, 31 days or fewer · In force since August 4, 2021
- The community of owners must approve first
- Since the Horizontal Property Law change in force from April 3, 2025, an owner who wants to run tourist rentals in a flat must first get the community of owners' express approval, decided under article 17.12. The community president can demand that unapproved activity stops immediately.3 Applies to: flats in buildings under horizontal property (communities of owners) · In force since April 3, 2025
- A 3/5 vote can approve, limit or ban tourist rentals in the building
- Approving, limiting, conditioning or prohibiting tourist rentals needs the favourable vote of three-fifths of owners who also hold three-fifths of the ownership shares. The same majority can set special expense quotas for the flat, up to a 20% increase. These agreements are not retroactive.3 Applies to: communities of owners · In force since April 3, 2025
- Existing tourist rentals may continue on their existing terms
- An owner already running tourist rentals before the law came into force, under the sectoral tourism rules, may keep going on the conditions and deadlines of that regime. For a Barcelona HUT that regime ends in November 2028.1,3 Applies to: owners already operating under the tourism rules before 2025-04-03 · In force since April 3, 2025
Operating rules
Operating Rules for Barcelona Short-Term Rentals
- A HUT is a whole home let for 31 days or fewer
- A tourist-use dwelling is a home let for a stay of 31 days or fewer, in its entirety, and it cannot be shared with other groups.23
- The Constitutional Court upheld decree-law 3/2023
- On March 13, 2025 the Constitutional Court (STC 64/2025, appeal 798-2024, brought by People's Party deputies) dismissed the challenge to decree-law 3/2023. The city cites this ruling as backing for ending the licences.15,26 In force since March 13, 2025
- Rentals over 31 days are ordinary leases, not tourist rentals
- The city said in 2021 that room rentals of more than 31 days for regular or long-term use are governed by the Civil Code and the Urban Leases Act (LAU), not by the tourist-rental rules, and remain allowed. Whole-home stays over 31 days fall outside the HUT definition for the same reason.23,25 Applies to: stays over 31 days · In force since August 4, 2021
- Habitability certificate and a guest limit
- A HUT needs a habitability certificate (cèdula d'habitabilitat), and no more people may stay than the certificate allows. Over-occupancy can be sanctioned as a serious infringement (3,000 to €60,000).23,27
- 24-hour phone line for incidents
- Legal HUTs must give visitors a telephone line available 24 hours a day to resolve incidents linked to the stay; the owner or managing agency must also give neighbours a number to reach for queries or incidents.23
Taxes
How Much Are Airbnb Taxes in Barcelona?
€9.50 per person per night in a Barcelona tourist-use flat since April 1, 2026 (€4.50 regional IEET + €5.00 city surcharge), for a maximum of 7 nights per person per continuous stay. What the host still handles
- Hold a valid HUT licence and its Catalan Tourism Register number, which the tax declaration requires.
- Register the establishment with the Agència Tributària de Catalunya and file the IEET self-assessment (model 950) twice a year: 1 to 20 October for April to September stays, 1 to 20 April for October to March stays. No filing is needed when nothing is due.
- Charge the tax to guests and show it separately on the invoice, with the number of stay units and the rate applied.
- VAT registration if you provide hotel-type services; from December 1, 2026 also for any furnished let of up to 30 nights outside your own main home, if Royal Decree-law 29/2026 is validated (confirm with the AEAT).5,9,10,17,18,19,20,21,22,34,35,39
Fines
How to Avoid Airbnb Fines in Barcelona
Fines in Barcelona fall on hosting without the approvals described above, or outside the rules. With them in hand and the rules followed, none of the fines below apply.
- Running a tourist rental without the required licence is a serious or very serious infringement, with fines from 3,001 to €600,000. Owners, the people running the activity and those who help can be sanctioned by the city or the Generalitat.28
- Very serious infringements of the Catalan Tourism Law can be fined from 60,000 to €600,000 (the range the city cited when it opened seven such files in June 2026 against a Barcelona building with fraudulently divided licensed flats and unlicensed units).27
- Serious infringements, for example over-occupancy, can be fined from 3,000 to €60,000.27
- The city opens restitution and cessation files against tourist flats operating without a permit, which can end in the licence being voided. If a flat is sealed while guests are inside, the city rehouses them at no cost and later bills the owner of the unlicensed flat. The usual procedure takes 6 to 12 months from start to closing of the file.23,27

FAQ
Barcelona Airbnb Rules: Frequently Asked Questions
Is Airbnb legal in Barcelona?
Is Barcelona banning Airbnb in 2028?
The City Council plans not to renew its roughly 10,000 tourist-flat licences when they expire in November 2028, under Catalan decree-law 3/2023, which the Constitutional Court upheld in March 2025. The decree-law lets a holder ask for a single extension of up to five more years, but the city says it will not renew licences.1,12,13,15
Can I get a new tourist licence (HUT) in Barcelona?
Can I Airbnb my condo or apartment in Barcelona?
Can tenants Airbnb in Barcelona?
Can I rent a room (lloguer d'habitacions) in my Barcelona apartment to tourists?
Should I buy a Barcelona flat that already has a HUT licence?
Any HUT licence a flat holds is due to end in November 2028, and the city creates no new ones, so the right to let to tourists has a fixed end date. The decree-law allows one extension request of up to five more years, but the city says it will not renew; the city's public look-up tool shows whether an address is licensed.1,12,13,26
What happens if I Airbnb without a licence in Barcelona?
Running an illegal tourist rental is a serious or very serious infringement, with fines from 3,001 to €600,000. The city also opens restitution and cessation files and bills owners for sealing flats: in 2025 it carried out more than 8,500 inspections, leading to 577 sanction files and 849 restitution files.23,27,28
How much is the Barcelona tourist tax on Airbnb?
For a tourist-use flat in Barcelona city the total is €9.50 per person per night since 1 April 2026: €4.50 regional tax (IEET) plus a €5.00 city surcharge. Does Airbnb collect the Barcelona tourist tax for me?
Catalan law makes the licence holder responsible for collecting the tax from guests and filing it with the Catalan Tax Agency twice a year (model 950). Platforms can collect it only if the Tax Agency has authorised them under an agreement, so check the tax lines on your booking to see whether it has been charged.19,34,35
Do I need a registration number on my Barcelona Airbnb listing?
Yes. Every legal HUT has a Catalan Tourism Register number (NIRTC) that must appear in all advertising and marketing, on a poster inside the flat, and be given to guests after they book. In 2025 Spain's Consumer Ministry ordered Airbnb to remove 65,935 listings, mainly for missing or invalid licence or registry numbers.23,28,32
Does the national Spanish registration number (NRA) still apply?
Royal Decree 1312/2024 created a Spain-wide rental registry with effects from 1 July 2025, but on 19 May 2026 the Supreme Court annulled the provisions creating that registry while upholding the digital one-stop shop and platforms' duty to send data. In Barcelona the Catalan HUT licence and register number remain the ones that matter.2,16,28
Do I have to charge VAT on a Barcelona Airbnb stay?
Today only if you provide hotel-type services such as reception, regular cleaning or laundry, in which case the stay is taxed at 10% VAT; a tourist let without those services is exempt. Royal Decree-law 29/2026, in force since 8 October 2026 and awaiting validation by the Congress's Diputación Permanente, sets 10% VAT on every furnished let of up to 30 nights from 1 December 2026, except in the host's own main home. It sets 10%, not the 21% announced in June.4,10,17,40

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 11,200 active Barcelona Airbnb listings over the 12 months to September 2026.
