Permit

Do You Need a Permit for Airbnb in Madrid?

Yes. Short-term rental hosts in Madrid need the Community of Madrid responsible declaration for a tourist home from Dirección General de Turismo y Hostelería of the Community of Madrid for the registration, and the Ayuntamiento de Madrid for the activity licence. It costs €414 in the first year (A home of up to 50 m² pays €414.00 to the council and nothing to the region; the CIVUT technician, insurance and any works are extra, and larger homes pay €654.12 or €931.50.) and €0 a year to renew.1,5,6,8,20,25,26

Who qualifies

  • The entire home is let, with a CIVUT suitability certificate signed by a technician after an on-site check and civil liability insurance in force
  • The owners' community has approved the use (three fifths of owners and shares for new registrations since 3 April 2025) and its statutes do not ban tourist use
  • Inside the historic centre (APE 00.01) the council issues no licences for dispersed tourist flats in residential buildings; only buildings that are not residential, or whole listed buildings under conditions, can qualify
  • Outside the historic centre a flat in a residential building needs its own independent street entrance and must be on the lower-ground, ground or first floor
  • The home is not publicly protected housing

How to apply

  1. Check that the building's owners' community has approved tourist use, that its statutes do not ban it and that the home is not protected housing.
  2. Check the Plan RESIDE rules for the address: no new licences for dispersed tourist flats in residential buildings of the historic centre; elsewhere own street access on the lower-ground, ground or first floor.
  3. Apply to the council for the urban-planning activity licence for lodging use and pay the municipal fee.
  4. Have a technician sign the CIVUT after an on-site visit and take out civil liability insurance.
  5. File the declaration online through the Community of Madrid's digital account with an accepted electronic signature.
  6. Put the registration number (format VT00000) in the Airbnb listing, fix the official plaque by the entrance, and report each guest to the Ministry of Interior.

FAQ

Madrid Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Madrid?

Yes, for entire homes that are registered with the Community of Madrid and licensed by the city. The Plan RESIDE, in force since September 2025, bars new licences for dispersed tourist flats in residential buildings of the historic centre.8,15,20

Do I need a permit or licence for Airbnb in Madrid?

Yes, two: the free regional declaration that enters the home in the Register of Tourism Enterprises, and the council's activity licence (licencia urbanística de actividad y funcionamiento). The listing shows the regional number, format VT00000.8,20,25

How much does the licence cost in Madrid?

The regional declaration is free. The council's fee for the activity licence is €414.00 for a home of up to 50 m², €654.12 for 50 to 100 m² and €931.50 for 100 to 500 m², plus the technician who signs the CIVUT and any works.6,8

Can I list a flat in the centre of Madrid on Airbnb?

Not as a new tourist flat in a residential building: inside the historic centre the council gives no licences for dispersed tourist flats, even on the ground floor. Buildings that are not residential, and whole listed buildings under a 15-year licence, are the exceptions.5,15

Can I rent out a home I don't live in?

Yes, if the entire home is registered, licensed by the city and approved by the owners' community. Outside the historic centre a flat in a residential building needs its own street entrance and must be on the lower-ground, ground or first floor.5,8,15

Can I rent a single room on Airbnb in Madrid?

The regional tourist-home declaration covers entire homes only, and room rentals do not file it. Guest reporting to the Ministry of Interior still applies to every host.8,27

Do my neighbours have to agree to tourist rentals in my building?

Yes, for new registrations: three fifths of the owners, holding three fifths of the shares, must approve since 3 April 2025, and the statutes must not ban tourist use. It is not retroactive.8,12

Does Airbnb collect hotel or tourist tax in Madrid?

No. Spain is not among the places where Airbnb collects and remits taxes for hosts, and Madrid has no tourist-stay tax: the Community of Madrid is the only region with no taxes of its own.6,10,28

Is VAT charged on Airbnb stays in Madrid?

At present VAT applies to a tourist let only where the host also provides hotel-type services. Royal Decree-law 29/2026, awaiting validation by Congress, would apply 10% VAT to furnished lets of up to 30 nights from 1 December 2026, except the host's own main home.3,11

What is the fine for hosting without a licence in Madrid?

Without the regional declaration the fine is €30,001 to €300,000. The council fines a tourist flat without its licence €30,001, then €60,001 and €100,001 if the activity continues, and it imposed 117 such sanctions in 2025.2,15,16

Is there a minimum stay or a night cap in Madrid?

The regional decree sets neither a minimum stay (a five-day minimum was annulled by the regional High Court in 2016) nor a yearly night cap. Stays of more than 31 days fall under national tenancy rules.4,7,22

Do I need the national registration number (NRUA) in Madrid?

No. The Supreme Court annulled the national registration procedure on 19 May 2026, and Airbnb no longer requires the number. The regional registration number and the city licence are still needed.13,26

How many Madrid Airbnbs are registered?

Tourist homes with a Madrid city licence: 1,483 as of September 202619. In AirROI's listing data, 59% of the 16,500 Madrid Airbnb listings active in the 12 months to September 2026 displayed a permit, licence or registration number. A number on a listing shows the host entered one; it doesn't confirm the permit is valid.

How much does an Airbnb make in Madrid?

The average Madrid listing earned US$31,200 in the 12 months to September 2026, according to AirROI, averaged across every active listing including those booked for only part of the year. The Madrid Airbnb market report breaks it down by month, property size and neighborhood.

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.

Listing figures come from AirROI's tracking of 16,500 active Madrid Airbnb listings over the 12 months to September 2026.
