Permit

Do You Need a Permit for Airbnb in Spain?

Yes. Short-term rental hosts in Spain need the Regional tourist registration or licence from tourism department of each autonomous community (for example the Tourism Register of Catalonia, the Register of Tourism Enterprises of the Community of Madrid, or the Tourism Register of Andalusia), plus the council's licence or compatibility report where the city requires one.9,20,21,22,23,24

Who qualifies

  • The home is registered in the regional tourism register and holds a habitability certificate (cédula de habitabilidad), which sets the guest limit
  • The owners' community has approved the use (new registrations since 3 April 2025)
  • Municipal zoning allows tourist use; a council licence or urban-planning certificate is needed where the city or Catalan Decree-Law 3/2023 requires it
  • Madrid also asks for a suitability certificate (CIVUT) and civil liability insurance

How to apply

  1. Check that the building's owners' community, the city's zoning and the region's rules allow tourist use
  2. Get the habitability certificate (and, in Madrid, the CIVUT suitability certificate) and, where required, the council's compatibility report
  3. File the sworn declaration (declaración responsable) online with the regional tourism department using a digital certificate
  4. Enter the regional registration number in the Airbnb listing's regional number field
  5. Register the accommodation and report each guest with the Ministry of Interior (Registro de Viajeros)

Applications go through the official application page .

FAQ

Spain Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Spain?

Yes, with the regional tourist registration or licence for the home. Spain has no single national permit, and regions, councils and building owners add their own conditions; several cities are closing or capping new tourist homes.6,21

Do I need a permit for Airbnb in Spain?

Yes, from your region. Tourist homes are entered in the regional tourism register (for example Madrid's Register of Tourism Enterprises or the Tourism Register of Catalonia), which issues a registration number to show in the advert.22,23

Do I need the national registration number (NRUA) for Airbnb in Spain?

No. The Supreme Court annulled the national registration procedure in ruling 620/2026 on 19 May 2026, and Airbnb no longer requires the number to publish a listing. The regional number is still needed.7,20

Can I rent out a flat I don't live in?

Often yes, if the region registers it, the owners' community approves it and the city's zoning allows it. Barcelona plans to end its tourist-flat licences in 2028, Málaga has suspended new ones, and Seville takes no new permits in twelve neighbourhoods.14,16,25

Do my neighbours have to agree to tourist rentals in my building?

Yes, for new tourist homes in flat buildings since 3 April 2025: the express approval of three fifths of the owners, who must also hold three fifths of the ownership shares, is required. It does not apply retroactively to homes registered earlier.4,22

Does Airbnb collect hotel or tourist tax in Spain?

No. Spain is not among the places where Airbnb collects and remits taxes for hosts. Hosts in Catalonia and the Balearic Islands file the tourist-stay tax themselves, and VAT is the host's responsibility.10,11,27

How much is the tourist tax in Spain?

There is no national tourist tax. Catalonia charges €4.50 per person per night for a tourist home in Barcelona and €1.75 elsewhere (rising to €2.50 on 1 April 2027), for up to 7 nights; the Balearic Islands charge €2 per person per day, reduced in the low season.10,11,12

Is VAT charged on Airbnb stays in Spain?

At present VAT applies to a tourist let only when the host also provides hotel-type services. Royal Decree-law 29/2026, in force since 8 October 2026 and awaiting validation by Congress, would apply 10% VAT to furnished lets of up to 30 nights from 1 December 2026, except the host's own main home.2,8

Do I have to report my guests to the police?

Yes. Every host in Spain, including one renting a room in their own home, must register with the Ministry of Interior and report guest details for each booking under Royal Decree 933/2021, enforceable since 2 December 2024.26

What is the fine for hosting without registration or reporting guests?

Not registering as an accommodation provider or not reporting guests is a serious infringement with fines from €601 to €30,000. Regions and councils set their own fines for unlicensed tourist homes, and Consumer Affairs fined Airbnb €64,055,311 for advertising unlicensed homes.9,26

Can I rent a single room on Airbnb in Spain?

It depends on the region. Andalusia registers rooms as tourist accommodation, Catalonia has a shared-house category for hosts who live in the home, and Madrid registers whole homes only.22,23,24

How long can a guest stay under the tourist rules?

National tenancy law caps the tourist regime at 31 days, and the regions fix the exact length; Catalonia applies its rules to stays of 31 days or less. Longer stays fall under seasonal or ordinary tenancy rules.1,22

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
