Permit

Do You Need a Permit for Airbnb in Morocco?

Yes. Short-term rental hosts in Morocco need the operating authorisation under Law 80-14 from governor of the prefecture or province, after the regional investment centre (CRI) files the application and the regional unified investment commission gives its opinion; for homestay and alternative accommodation, the local authority (autorité locale).1,2,6,7

Who qualifies

  • Provisional classification first: the property must meet 100% of the mandatory equipment standards and at least 70% of the points of the complementary standards for its type and star category
  • A copy of the certificate of conformity of the building (certificat de conformité) goes into the application for classified establishments
  • Insurance against fire, theft of guests' belongings and civil liability must be in place before the authorisation is issued
  • Homestay: the host lives in the home, and files a copy of the electronic national identity card, photos of the rooms and common areas, the insurance contract, an occupancy permit (permis d'habiter) or an engineer's safety certificate, and the signed specifications (cahier des charges)

How to apply

  1. Classified establishments (guesthouse, riad, tourist residence): file the application electronically, against a receipt, with the regional investment centre (CRI) of the region where the property stands. The file holds the application form, the certificate of conformity and the equipment-standards self-assessment form for the chosen type and star category.
  2. The CRI forwards the file within 2 days to the governor (civil protection, hygiene and other opinions within 14 days) and to the regional tourism office, whose visit and provisional classification report is due within 14 days.
  3. The regional unified investment commission gives its opinion; on a favourable opinion the tourism office issues the provisional classification within 2 days.
  4. File the insurance contract with the CRI; the governor issues the operating authorisation within 2 days of receiving it. Notify the CRI within 60 days of opening to start the operating classification.
  5. Homestay or alternative accommodation: file the request, against a receipt, with the local authority, which forwards it within 2 days for a site visit and decides within 30 days.

Applications go through the official application page .

FAQ

Morocco Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Morocco?

Yes, with an operating authorisation. Law 80-14 lets a person host tourists for one or more nights in the home where they live, and lets operators run guesthouses, riads and tourist residences, but each form needs an authorisation first.1

Do I need a permit for Airbnb in Morocco?

Yes. Opening a tourist accommodation or running another form of tourist accommodation requires an operating authorisation (autorisation d'exploitation), filed electronically through the regional investment centre or, for a homestay, with the local authority.1,2,6

How much does the authorisation cost?

The decree and the ministry's procedure pages list no application fee, only the documents to file. Hosts pay for the standards they must meet, the insurance contract and the safety certificate.2,6

Can I rent out a home I don't live in?

Only through a classified category. Law 80-14 has no category for a lone furnished apartment; the nearest is the tourist residence, which needs provisional classification and an operating authorisation, and even at one star must keep reception staff on duty 24 hours a day. The homestay route is for the home where you are domiciled.1,2

Can I rent a room in my own home?

Yes, as a homestay. The authorisation is valid for five years and is decided within 30 days; the maximum number of rooms is fixed by a joint order of the Interior and Tourism ministers.1,2

Does Airbnb collect hotel or tourist tax in Morocco?

No. Morocco is not on Airbnb's list of areas where it collects and remits taxes, so the host collects the tourist tax from guests and pays it to the commune each quarter.3,14

How much is the tourist tax in Morocco?

It is a flat amount per person per night, set by each commune: MAD 15 to 30 for guesthouses, MAD 10 to 25 for riads and houses let to tourists and MAD 3 to 7 for tourist residences. Children under 12 are exempt.3,8

What is the fine for renting without authorisation?

A fine of MAD 50,000 to 500,000, doubled for a repeat offence within five years. Missing guest reports can bring one to six months in prison, a fine of MAD 50,000 to 100,000, or both.1

Do I have to report my guests to the authorities?

Yes. The operator declares guest data electronically on the day of arrival, asks each guest for identity documents and a signed form, and keeps the forms for one year.1,13

Is insurance mandatory for hosts?

Yes. Operators need insurance against fire, theft of guests' belongings and civil liability. Failing to take it out is fined MAD 50,000 to 500,000, or MAD 10,000 to 100,000 for homestay hosts.1

Is there a limit on the nights I can let?

Law 80-14 and the 2023 decree set no annual night cap and no minimum stay. A homestay has a cap on rooms that is still to be fixed by a joint order.1,2

Are new rules coming for platform rentals?

Yes. In June 2025 the Ministry of Tourism announced further orders for homestays and alternative accommodation that will also cover products offered on the most-used platforms, and in January 2026 the housing secretary said a decree on buildings used for short-term rental is being prepared.7,15

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. Decree 2-23-441 (BO 7462) is a scanned PDF that the script reader cannot read: its quotes come from OCR of the official PDF (marked readVia browser). The 2026 General Tax Code and Law 47-06 PDFs exceed the script reader's length limit, so quotes from late pages were read in the PDF text.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
