Your home
Can You Host an Airbnb in South Lake Tahoe? It Depends on the Home
Whether you can host in South Lake Tahoe turns on whose home it is and whether you live there.
A home in the Tourist Core or a commercial zone
Allowed with conditionsAllowed with a city vacation home rental permit, and these zones are not subject to the 900 cap or the waitlist. The annual fee is $200 to $850 by occupancy, plus the $565 application; the property-manager, monitoring and 25-year renter-age rules apply only to residential areas.2,5,6,7
A house or condo in a residential neighborhood
Allowed with conditionsAllowed only with a permit, and since August 21, 2026 new applications go on a waitlist because the city is approaching the 900-permit cap. Hosts who obtain a permit need a local property manager, noise and video monitoring and a passed inspection, and the annual fee is $670 to $3,485.2,5,6,7
A rented home or apartment (tenant hosting)
Allowed with conditionsA tenant cannot hold a vacation home rental permit, which goes only to owners. A tenant can apply for a hosted rental permit with a lease of at least two years, the owner's written permission and a notarized affidavit that the home is their principal residence.2,9
A condominium or a unit in a multifamily building
Allowed with conditionsCondominiums are eligible for a vacation home rental permit unless the homeowners association prohibits short-term rentals. Apartments and other multifamily units that share a wall, floor or ceiling with another unit are not allowed.2,5
Permit
Do You Need a Permit for Airbnb in South Lake Tahoe?
Yes. Short-term rental hosts in South Lake Tahoe need the vacation home rental permit from the City of South Lake Tahoe, through its online VHR permit portal. It costs $1,520 in the first year (A home in a residential area with a maximum occupancy of 4 pays $565 application, $285 inspection and a $670 annual fee, $1,520 in the first year. The annual fee rises to $1,340 at 5 to 8 occupants, $2,680 at 9 to 12 and $3,485 at 13 or more; in the Tourist Core and commercial zones it is $200 to $850.) and $670 a year to renew.2,5,6,7,10
- Who needs it
- Any owner who rents an entire dwelling unit for fewer than 30 consecutive nights, before advertising, renting or operating it; a tenant or an owner who stays in the home during the rental uses the separate hosted rental permit instead.2,5,6,7,10
- Issued by
- City of South Lake Tahoe, through its online VHR permit portal
- Valid for
- One year from issuance. The owner must renew before the permit expires (the online account opens for renewal about 30 days earlier); an expired permit cannot be renewed, and a new application is needed that in residential areas is subject to the cap and waitlist. The permit is tied to the owner and the address and cannot be transferred, except into a family trust of which an owner is trustee.
- Processing
- City staff has 30 days to review an application; the total time depends on payments, inspection availability and corrections. Applications for residential areas wait on the waitlist until a permit slot opens, and the city gives no estimate. The city issues at most 150 permits a month.
- On listings
- The number must appear on every listing
- Platform checks
- The permit number must appear in all marketing, advertising and contracts. The city screens online listings with Rentalscape software and has asked rental platforms to remove advertisements for unpermitted homes.

Who qualifies
- The applicant must hold title: the property must be fully purchased and titled in the name of the person or entity applying, and homes listed for sale, in escrow or awaiting closing cannot apply.
- Single-family homes and condominiums qualify; condominiums in a homeowners association that prohibits short-term rentals do not, and other multifamily units are barred.
- One vacation home rental per parcel.
- In residential areas, the 900-permit cap applies and new applications go on a waitlist; the Tourist Core and commercial zones are not capped.
- In residential areas, an on-site inspection (including defensible space) must be passed before the permit is issued, and the home needs paved parking sized to the occupancy.
- No permit is issued where the property or applicant has three or more upheld citations from separate events in 24 months, or outstanding fines.
How to apply
- Check the property's zone with the city's zoning lookup and its Issued Permit Map; residential-zone applications go on the waitlist once the 900-permit cap is reached, while Tourist Core and commercial properties are not capped.
- Submit the application in the city's online VHR permit portal; city staff has 30 days to review it and tell the applicant the next step by email.
- Pay the application and inspection fees when the city sends the payment email, then schedule and pass the inspection (a re-inspection costs extra).
- Pay the annual fee when the city sends the occupancy/annual fee email; the city then issues the permit by email.
- Register the home with the city tax collector for transient occupancy tax, and put the permit number on every listing, contract and advertisement.
Applications go through the City of South Lake Tahoe, through its online VHR permit portal application portal .
Permit rules
- City permit before advertising or renting
- A city-issued vacation home rental permit is required before a dwelling is advertised, rented or operated as a short-term rental, which is generally a rental of fewer than 30 consecutive calendar days.6
- No renting or advertising while pending or waitlisted
- An applicant may not advertise, rent or operate the home until the city has issued an active permit; submitting an application or sitting on the waitlist does not authorize any short-term rental.6
- One-year permit that cannot be transferred
- A permit expires one year after issuance and must be renewed before it lapses. It does not pass to a buyer, a new property or another person; a change of ownership needs a new application, with a limited exception for a transfer into a family trust of which an owner is trustee.2,6
- Permit number on every ad and contract
- All marketing, advertising, contracts and rental agreements must show the city permit number, and a copy of the permit and the operating conditions must be posted inside the home. In residential areas the advertisement must also say the property is in a residential area subject to enhanced regulations and enforcement.2,5
- Permit revoked after three upheld citations or unpaid hotel tax
- The city manager revokes a permit after three or more upheld citations from separate events or calls for service within 24 months, when hotel tax is not current, or on a material misrepresentation or attempted transfer. A revoked permit is treated as expired, and the decision can be appealed to a hearing officer.2
- Advertised price must include mandatory fees
- Since July 1, 2024, California's Honest Pricing Law (SB 478) bars a host or platform from advertising a short-term rental price that leaves out mandatory fees such as a cleaning fee; government taxes and fees may be listed separately.4 In force since July 1, 2024
Who can host
Who Can Host an Airbnb in South Lake Tahoe, and Where
California state law applies on top of South Lake Tahoe's own rules: the California short-term rental regulations page covers the state license and what cities and counties can and can't regulate.
- Whole-home rentals under 30 nights are covered
- The vacation home rental rules cover renting an entire dwelling unit for fewer than 30 consecutive calendar days; rooms in city-approved hotels, motels, timeshares and bed and breakfasts are not vacation home rentals, and a host who stays in the home uses the hosted rental permit instead.2,9 In force since April 23, 2026
- Only an owner who holds title can get a permit
- Vacation home rental permits are issued only to the owners of the property, and the property must be fully purchased and titled in the applicant's name before an application is made; homes listed for sale, in escrow or awaiting closing cannot apply.2,6
- What counts as a residential area
- Residential areas are areas zoned for residential use, excluding the Tourist Core Area Plan, the Tahoe Valley Area Plan, the Sierra Tract commercial area, the South Y Industrial Tract, Bijou/Al Tahoe Community Plan Districts 1 to 4 and recreation-zoned parcels; the city's zoning lookup shows which applies to an address.2,5 In force since April 23, 2026
- 900-permit cap in residential areas
- No more than 900 vacation home rental permits may be issued in residential areas. Ordinance 2026-1203, effective April 23, 2026, replaced the earlier 150-foot spacing buffer with this cap; the Tourist Core and commercial zones are not capped.2,5 Applies to: Residential areas · In force since April 23, 2026
- Residential applications waitlisted since August 21, 2026
- From August 21, 2026 the city places new residential-area applications on a waitlist because issued permits are approaching the 900 cap; applications are not reviewed until a slot opens and the city gives no estimate. Tourist Core and commercial applications are unaffected. The city issues at most 150 permits a month.2,5,6 Applies to: Residential areas · In force since August 21, 2026
- Apartments and other multifamily units are barred
- It is unlawful to rent a multifamily dwelling unit, one that shares a wall, floor or ceiling with another unit (condominiums excepted), as a vacation home rental.2,5
- Condominiums qualify unless the HOA prohibits rentals
- Condominiums can hold permits since April 23, 2026, except those in a homeowners association that prohibits short-term rentals; the applicant declares that no covenant or restriction bars a permit.2,5 Applies to: Condominiums · In force since April 23, 2026
- One rental per parcel
- No more than one vacation home rental may operate on a parcel.2
- Hosted rentals: a room while you live there
- A hosted rental, in which the owner or a qualifying tenant hosts guests in their own principal residence and stays overnight, uses a separate permit and is outside the vacation home rental rules and the 900 cap. Separate duplex units, multifamily units and accessory dwelling units do not qualify; a tenant needs a lease of at least two years and the owner's written permission.5,9 Applies to: Hosted rentals · In force since November 17, 2020
- Accessory dwelling units cannot be rented short-term
- The Tahoe Regional Planning Agency prohibits accessory dwelling units in the Tahoe Basin from being used as short-term or vacation home rentals.11 Applies to: Accessory dwelling units

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Revenue and Taxation Code section (s3) was read from an Internet Archive copy dated September 29, 2025.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 1,810 active South Lake Tahoe Airbnb listings over the 12 months to September 2026.
