Earnings

What Could a Short-Term Rental in Delaware Earn?

The rules shape the numbers: a license that costs $200 a year and taxes of 4.5% that Airbnb adds to guests' bills. For a specific address, the short-term rental calculator estimates revenue, occupancy and nightly rate from comparable listings, so you can test the numbers before applying.

FAQ

Delaware Short-Term Rental Laws: Frequently Asked Questions

Is Airbnb legal in Delaware?

Yes. Delaware taxes short-term rentals of up to 31 nights at 4.5% rather than banning them, and each town decides whether to license them. Most beach towns allow them with a rental license, while Selbyville prohibits them and Newark treats them as banned.1,28,32

Do I need a permit for Airbnb in Delaware?

Not from the state if you book only through a platform, but you need a rental license from the town where the home stands, such as Lewes, Rehoboth Beach, Bethany Beach, Ocean View, Dewey Beach or Millville. An owner who books guests directly also needs the state's $25 accommodations intermediary license.5,7,10,20,22,24,30

How much is a short-term rental license in Delaware?

The town sets it: Lewes charges $200 a year, Ocean View $150, Bethany Beach $100 and Millville $50. The state's accommodations intermediary license is $25 a year and applies only to owners who book guests without a platform.11,16,20,22,30

Can I rent a home I don't live in?

In most beach towns, yes, if you own it and hold the town rental license; Lewes requires the applicant to have an ownership interest. Selbyville and Newark do not allow short-term rentals in any home.7,28,32

Does Airbnb collect hotel tax in Delaware?

Airbnb collects the 4.5% state short-term rental lodging tax, excluding the cleaning fee. Its Delaware help page lists no town tax, so owners file the town's rental tax themselves unless a town ordinance, as in Dewey Beach since April 25, 2025, puts collection on the intermediary.10,26,33

What is the lodging tax on an Airbnb stay in Delaware?

The state tax is 4.5% of the rent for stays of up to 31 nights. Town taxes come on top: 7% in Rehoboth Beach and Bethany Beach, 6% in Ocean View, 5% in Lewes (5.5% from January 1, 2028), 3% in Dewey Beach and 2% in Millville.1,8,14,17,20,23,25,31

What is the fine for operating without a license?

It depends on the town. In Lewes a third violation costs $500 and a 12-month license suspension, and the fine doubles if unpaid after 30 days; in Selbyville the license is revoked and the owner is fined each day; in Rehoboth Beach each day of violation is a separate civil offense.5,16,29

Is there a limit on how many guests or nights?

The towns researched cap guests rather than nights: Rehoboth Beach, Lewes, Dewey Beach and Millville allow two persons per bedroom plus two more. Delaware's tax rules treat any stay of up to 31 consecutive nights as a short-term rental.1,7,13,24,30

Do I have to show a license number on my Airbnb listing?

In Lewes every advertisement must show the city's rental identification number. State law also requires an accommodations intermediary to put its Delaware license number on marketing for each rental unit.1,15

Does the 4.5% state tax apply to the cleaning fee?

No. Airbnb charges the 4.5% on the listing price excluding any cleaning fee, and state law excludes cleaning fees from taxable rent.10,33

Can a Delaware town ban short-term rentals?

Yes. Selbyville's Mayor and Council adopted an ordinance on July 7, 2025 that defines short-term rentals as rentals of less than one year and prohibits them, and Newark's planning department treats its zoning code as a ban.28,32

Does Sussex County tax Airbnb stays outside the towns?

Not at the county level. Sussex County's 3% lodging tax applies to hotels, motels and tourist homes in unincorporated areas, and the County Council voted 3-2 against extending it to short-term rentals; the 4.5% state tax still applies.4,10,34

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Wilmington rental-license page was read in a browser because the page reader returned nothing.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the state agency and your city or county has the final word on any application.
