  • Bend: a land use permit and an annual operating license; whole-house Type II rentals need 500 feet of separation from other whole-house rentals
  • Lincoln City: no new licenses in the R1-5 zone (cap 194) or the R1-RE zone (cap 91) because both caps are reached
  • Seaside: one short-term rental license per owner; Rockaway Beach: new licenses wait on a list because the 420-license cap is exceeded
  • Eugene: free annual registration; unincorporated Deschutes County: Certificate of Authority renewed annually

How to apply

  1. Find the city or county that regulates the address and check zoning; some Portland addresses carry another city's postal name.
  2. Apply through the local portal, for example Portland's Civic Portal for a Type A permit, Bend's Online Permit Center Portal or Eugene's online registration.
  3. Register for the state lodging tax and any city or county lodging tax account, and put the permit number in every advertisement where the city requires it.

FAQ

Oregon Short-Term Rental Laws: Frequently Asked Questions

Is Airbnb legal in Oregon?

Yes, in most places. Oregon sets a statewide lodging tax but leaves permits, zoning and license caps to cities and counties; Portland, Bend, Eugene, Seaside and Rockaway Beach each require a permit, license or registration.6,9,14,15,23,26,27

Do I need a permit for Airbnb in Oregon?

It depends on the address. Portland requires a Type A permit, Bend a land use permit and an operating license, Eugene a free annual registration, and unincorporated Deschutes County (including Sunriver) a Certificate of Authority.9,14,15,18

How much does a short-term rental permit cost in Oregon?

Portland charges $504 every two years for a Type A permit; Bend charges $350 to start and $255 a year plus a transportation fee; Seaside charges $500 to apply; Rockaway Beach charges $500 a year; Eugene registration is free.4,11,14,16,26

Can I rent a home I don't live in?

Sometimes. Portland does not allow whole-home rentals without a resident in residential zones, while Bend issues Type II whole-house permits with a 500-foot spacing rule; Lincoln City has no room in two capped residential zones.10,14,21

Is there a limit on how many nights I can host?

There is no statewide cap. Portland lets a resident rent while away for up to 95 days a year, Bend's infrequent permit allows four rental periods and under 30 days a year, and Rockaway Beach requires 30 rented days to renew.9,14,26

Does Airbnb collect hotel or lodging tax in Oregon?

Yes. Airbnb collects the 1.5% state tax and the city and county taxes listed on its Oregon page, but hosts stay responsible for all other tax obligations, and Deschutes County hosts still file county reports.18,28

What is the lodging tax on an Airbnb stay in Oregon?

The state tax is 1.5% on every stay, plus local taxes: Bend 10.4%, Seaside 10% with 3% to Clatsop County, Deschutes County outside cities 8%, and in Portland 6% city, 5.5% county, a 3% tourism fee and $4 a night.6,12,14,18,25,28

Is the Oregon state lodging tax going up?

Yes. For consideration charged on or after January 1, 2027 the state lodging tax is 2.75%, up from 1.5%, under House Bill 4134, and the added 1.25% is labeled a nature conservation fee.6,7

What is the fine for an illegal short-term rental in Oregon?

It depends on the city. Portland fines $1,829 for a first offense, $5,475 for a second and $9,122 for a third and later offenses; Seaside fines $250 up to $2,000 and can revoke the license.4,11

Do I need to show a permit number on my Airbnb listing?

In Portland, yes: the permit number must be in all advertising, and invalid numbers lead to delisting from Airbnb. Unincorporated Deschutes County also requires the certificate number in rental ads.9,13,19

Are there caps on short-term rental licenses?

Some cities cap them. Lincoln City has reached its caps of 194 in the R1-5 zone and 91 in the R1-RE zone, and Rockaway Beach's 420-license cap is exceeded, so new applicants wait on a list.21,26

Is a stay of 30 nights or more taxed?

No state lodging tax applies when the same person occupies a dwelling for 30 consecutive days or more. Portland also stops charging its lodging tax after the first 30 days.2,12

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Eugene, Lincoln City and Rockaway Beach city pages and Rockaway Beach code were read in a browser, the Eugene FAQ and Lincoln City code from Internet Archive copies.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the state agency and your city or county has the final word on any application.
