A second home or investment property let full-time
Allowed with conditionsNon-hosted letting is capped at 60 nights a year unless the property is on the mapped 365-night land in the Byron Bay town centre or at Brunswick Heads, where it can run all year. Check the address on the NSW Government's precinct map before relying on 365 nights.2,10,16

Permit
Do You Need a Permit for Airbnb in Byron Bay?
Yes. Short-term rental hosts in Byron Bay need the STRA Register registration from the NSW Department of Planning, Housing and Infrastructure, through the NSW Planning Portal. It costs A$65 in the first year (A host with one Byron Bay property pays A$65 to register and A$25 each year to renew; Byron Shire Council charges no separate licence fee for hosted or non-hosted letting.) and A$25 a year to renew.5,6,8,11,20
- Who needs it
- Every host of a house, unit, terrace or granny flat let for short stays in Byron Shire, hosted or not. Approved tourist and visitor accommodation such as hotels, serviced apartments and bed and breakfasts does not register. No council licence or approval is needed.5,6,8,11,20
- Issued by
- NSW Department of Planning, Housing and Infrastructure, through the NSW Planning Portal
- Valid for
- A registration runs for 12 months from the registration date and is renewed on the Planning Portal. A registration that is not renewed is held for 3 months, blocked from taking bookings from online platforms, and then de-registered.

- Platform checks
- A booking platform must not advertise premises unless they are on the register and the registration number is shown with the listing. Airbnb asks hosts to enter the NSW registration number in the Regulations section of the listing. The STRA Register records the nights a dwelling is let, using information shared by booking platforms, so councils can check the day limit.

- Boarding houses, seniors housing, rural workers' dwellings, group homes, hostels, co-living housing, refuge or crisis accommodation and moveable dwellings such as caravans and tents cannot be registered.
- Granny flats approved under the Affordable Rental Housing policy between April 2011 and November 2019 carry consent conditions that prevent short-term rental.
- The dwelling must meet the STRA fire safety standard and the host must agree to follow the code of conduct.

How to apply
- Check the address against the Byron Bay and Brunswick Heads 365-night precinct maps if you plan to let when you are not there, and check the building's by-laws if it is strata.

Permit rules
- Register every property on the STRA Register
- Every short-term rental property in Byron Shire goes on the STRA Register on the NSW Planning Portal, for A$65 and then A$25 a year to renew. Approved hotels, serviced apartments, bed and breakfasts and similar tourist accommodation do not register.5,6 In force since March 1, 2022
- No council licence or permit is needed
- A host does not need a licence or permit to run a short-term rental; the register is the only state step, and Byron Shire Council allows hosted and non-hosted letting without its approval. A person who arranges stays for other owners may need a real estate agent licence under the Property and Stock Agents Act 2002.7,15
- Show the STRA property ID on the listing
- Registration issues an STRA property ID, and it must be displayed on the online property listing. The host must be registered before advertising or offering the property.6,8 In force since March 1, 2022
- Platforms may only advertise registered premises
- Under the mandatory code of conduct, a booking platform must not advertise short-term rental premises unless they are on the register and the registration number is shown with the listing.8 Applies to: booking platforms · In force since March 1, 2022
- Renew every year or lose the registration
- A registration must be renewed for A$25 each year from the date of the original registration. If it is not renewed by the expiry date it is held for a further 3 months, blocked from taking bookings from online platforms, and then de-registered; a new registration is then needed.5
- The register counts the nights
- The STRA Register records the number of nights a dwelling is let, from information shared by booking platforms or entered by the host for direct bookings. Airbnb adds bookings across platforms into one day count and leaves hosts responsible for watching their own calendar.11,20 Applies to: non-hosted STRA
Who can host
Who Can Host an Airbnb in Byron Bay, and Where
New South Wales state law applies on top of Byron Bay's own rules: the New South Wales short-term rental regulations page covers the state licence and what cities and counties can and can't regulate.
- A non-owner registers with the owner's consent
- A tenant, manager or other non-owner registering a property uploads confirmation of the owner's consent, along with any development consent that applies. A lease can add further restrictions.5,6 Applies to: tenants, managers and new owners
- Hosted letting has no night limit
- Where the host lives on the premises during the stay, short-term letting can run 365 nights a year anywhere in Byron Shire. Registration, the fire safety standard and the code of conduct still apply.15,17 Applies to: hosted STRA · In force since January 31, 2022
- Two mapped precincts keep 365 nights
- Only two parts of the shire are exempt from the 60-night cap: mapped land in and around the Byron Bay town centre, and mapped land at Brunswick Heads. A home elsewhere in Byron Bay, or elsewhere in the shire, is capped, so the address should be checked against the NSW Government's precinct map.10,16,18 Applies to: non-hosted STRA · In force since September 23, 2024
- No separate consent pathway beyond 60 nights
- The NSW Government decided not to build a development application pathway for non-hosted letting beyond the 60-night cap, saying it needed more time and legal work and that Council needed time to set up resources and an assessment framework. The cap is therefore the working limit for a non-hosted home outside the mapped precincts.17 Applies to: non-hosted STRA outside the mapped precincts · In force since September 26, 2023
- Granny flats approved from 2011 to 2019 cannot be let short-term
- A secondary dwelling (granny flat) approved between April 2011 and November 2019 under the Affordable Rental Housing policy carries consent conditions that keep it for permanent residents. Short-term rental is not permitted there, and unauthorised use may lead to enforcement action.15 Applies to: secondary dwellings
- Bed and breakfasts and farm stays need their own approval
- Short-term rental of a home stays a residential use. Bed and breakfasts, farm stays, serviced apartments and other tourist and visitor accommodation need an approved development application from Byron Shire Council instead, and do not register as STRA.5,15 Applies to: tourist and visitor accommodation
- Most homes qualify as exempt development in any zone
- Houses, units, terraces and granny flats can be let without council approval in any land-use zone if the registration, fire safety and other general requirements are met. Boarding houses, seniors housing, group homes, hostels, co-living housing and moveable dwellings cannot.5 In force since January 31, 2022
- Strata by-laws can ban non-resident letting
- An owners corporation can adopt by-laws restricting short-term rental, but only in lots that are not the host's principal place of residence. An owner who lives in the lot can still let it, and Byron Shire Council advises checking the by-laws before any non-hosted letting in a strata building.7,15 Applies to: strata lots · In force since April 10, 2020

- The cap now applies to every non-hosted registration
- The 60-night cap applied to all new registrations from 23 September 2024 and to existing registrations from their next renewal on or after that date. - Two strikes in two years mean a 5-year exclusion
- NSW Fair Trading can record strikes for serious breaches of the code of conduct; two strikes in two years can put a host, or a premises, on the exclusion register for 5 years, and platforms must block them.9 Applies to: hosts and guests · In force since August 2022
- The council checks the register for hosts over the cap
- Byron Shire Council is responsible for monitoring compliance with the night cap and can use the STRA Register to see when a non-hosted property passes its annual limit. Letting beyond the limit is unauthorised development and can lead to a compliance investigation.5,17 Applies to: non-hosted STRA · In force since September 23, 2024
- The rules cover stays of up to 3 months
- A short-term rental arrangement under the code is a commercial arrangement giving a right to occupy residential premises for no more than 3 months at one time.7 In force since December 18, 2020

Method
How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Byron Shire Council page (including its collapsed FAQ section), the Fair Trading Act 1987, the Fair Trading Regulation 2019 and the Housing SEPP section 112 on legislation.nsw.gov.au were read in a browser because they block scripted readers.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 1,000 active Byron Bay Airbnb listings over the 12 months to September 2026.
