FAQ

Portugal Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Portugal?

Yes. A home can be let to tourists once it has an Alojamento Local (AL) registration number from the local council. There is no cap on nights, but councils can close or limit new registrations in crowded areas such as parts of Lisbon, Porto and Funchal.1,8

Do I need a permit or licence for Airbnb in Portugal?

Yes. You file a prior notice with a deadline (comunicação prévia com prazo) online with the council, and the number is issued unless the council objects within 60 days, or 90 in containment areas. The number must then appear in every advertisement.1,9,11

How much does the AL registration cost?

There is no national fee. Each council sets its own filing fee and inspection fee; Porto, for example, charges a filing fee paid on submission and a separate inspection fee. Mandatory insurance of at least €75,000 per claim is a separate cost.1,16

Can I rent a home I don't live in?

Yes. Houses and apartments can be registered whether or not you live there; only the rooms category must be in your own home, with at most three rooms. Tenants need the landlord's written consent.1

Is there a limit on how many nights I can rent?

No. The 120-day seasonal rule and the five-year registration term introduced in 2023 were repealed from 1 November 2024. Capacity is capped at nine rooms and 27 guests.1,8

Does Airbnb collect hotel or tourist tax in Portugal?

Only in Lisbon (€4 per guest per night) and Porto (€3), each up to 7 nights. In other municipalities, such as Funchal (€2) and Albufeira (€2 from April to October), the host collects and pays the council.4,5,24

What is the fine for renting without registration?

An unregistered or outdated listing is a serious economic offence, with fines of €650 to €1,500 for an individual and up to €24,000 for a large company; the limits double if the gain exceeds the maximum fine. Closure for up to two years can follow.1,3

Can my neighbours or condominium stop me?

A condominium can ban AL for future registrations with a two-thirds vote, and a vote of more than half the permillage can ask the mayor to cancel a registration after repeated, proven disturbance.1

Can I get a new registration in Lisbon, Porto or Funchal?

Possibly, depending on the area. Funchal bars new registrations in the Sé parish and allows only houses and rooms in houses elsewhere; Porto designates five central parishes as containment areas; Lisbon sets containment areas by area ratios of 5% and 10%.6,14,16

Is insurance required?

Yes. Civil liability insurance of at least €75,000 per claim is mandatory, and proof must be filed on gov.pt; a lapse is a ground for cancelling the registration.1,11

Do I have to report my guests?

Yes. Foreign guests must be reported through the SIBA system within three working days of check-in.23

Are there changes coming?

Councils with more than 1,000 registrations have until 31 December 2026 to decide whether to adopt an AL regulation, and any extended suspension of new registrations ends by that date.7

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. Pages on diariodarepublica.pt, lisboa.pt, informacao.lisboa.pt and the Azores regional portal were read in a browser, because those sites do not return their text to automated requests.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
