Permit

Do You Need a Permit for Airbnb in Napa?

Yes. Short-term rental hosts in Napa need the City of Napa Vacation Rental Permit from the City of Napa Planning Division, Community Resources and Development Department. It costs $1,650 in the first year (A hosted permit costs $976 to apply and about $674 a year after approval, plus the annual fire inspection, 500-foot mailing labels and the city business license tax.) and $674 a year to renew.2,6,7,8,9

Who qualifies

  • Hosted permit: the owner lives at the home (domicile), sleeps there while it is rented, in a bedroom that is not rented, and rents no more than two bedrooms; residency is verified during review
  • Non-hosted permit (whole house): all 41 permits are taken and applications are not accepted; the only route is a transfer of an existing permit to a buyer of the property
  • Only the owner holding title can apply, and every title holder signs
  • The home cannot be under HOA bylaws or CC&Rs that prohibit vacation rental use, and an accessory dwelling unit cannot be rented
  • A property within 500 feet of a bed and breakfast inn or another vacation rental must show how it will limit the effect of concentrated transient use on neighbors

How to apply

  1. Watch the city's Vacation Rental Permits page for an application window; new applications are taken only during advertised periods, and non-hosted applications are closed.
  2. Confirm that you own the home, live in it, and that no HOA rules ban rentals.
  3. Email the signed PDF application to planningdepartment@cityofnapa.org with proof of ownership and residency, the rental agreement with the city's standard rules, a site plan and photographs, and mail the $976 check and two sets of 500-foot mailing labels.
  4. If your application is drawn in the lottery, complete the supplemental submittal, then pay the inspection fee and agree to the permit rules once the city conditionally approves it.
  5. After approval, register for the hotel tax and the business license, and pass the annual fire and life safety inspection.

Applications go through the official application page .

FAQ

Napa Airbnb Rules: Frequently Asked Questions

Is Airbnb legal in Napa?

Yes, but only with a City of Napa vacation rental permit, and permits are capped at 41 non-hosted (whole-house) and 60 hosted (owner-occupied) in the whole city. All 41 non-hosted permits are taken.2,6

Do I need a permit for Airbnb in Napa?

Yes. Short stays of under 31 days in a Napa home are a code violation without a city vacation rental permit, and every advertisement must show the permit number.2,6

How much is a Napa vacation rental permit?

A hosted permit application costs $976, and permit holders then pay an annual program fee of $674 for the 2026-2027 permit plus a yearly fire and life safety inspection billed in 30-minute increments.7,8

Can I rent a home I don't live in?

Only with a non-hosted permit, and all 41 are taken with a full wait list. The way in is to buy a home whose owner transfers a non-hosted permit, which the Community Development Director must approve.2,6

Are Napa vacation rental permit applications open?

Only during advertised windows. The city took hosted applications from October 1 to 15, 2026 and reviews them by lottery; non-hosted applications are not being accepted.6

Does Airbnb collect hotel tax in Napa?

No. Airbnb's California tax list does not name the City of Napa, so hosts register with the city, charge guests the taxes and file a monthly return themselves.3,10,19

What is the hotel tax on an Airbnb in Napa?

About 15% of the rent: the 12% transient occupancy tax, a 1% housing special tax and a 2% tourism improvement district assessment, all remitted to the City of Napa Finance Department.3,4,10

What is the fine for an illegal Airbnb in Napa?

$500 for a first violation, $750 for a second within 12 months and $1,000 a day for each further violation within 12 months, plus enforcement costs; the city can also revoke a permit.2

How many guests can stay at a Napa vacation rental?

The permit sets the number: no more than two guests per bedroom plus two more, and never more than 10 people sleeping at the home. The 2026 hosted application lists a maximum of 4 overnight occupants.2,7

Do I need to show a permit number on my Airbnb listing in Napa?

Yes. Every advertisement must include the "City of Napa Certified Vacation Rental" permit number.2

Can I run an Airbnb in unincorporated Napa County?

No. Napa County Code section 18.104.410 prohibits short-term rentals in every residential and agricultural area outside city limits, so the city permit does not help there.14

Can I rent out an accessory dwelling unit on Airbnb in Napa?

No. The city's code makes it a violation to use an accessory dwelling unit for transient occupancy.2

How many Napa Airbnbs are registered?

Non-hosted vacation rental permits taken: 41 as of September 20266. In AirROI's listing data, 0% of the 599 Napa Airbnb listings active in the 12 months to September 2026 displayed a permit, license or registration number. A number on a listing shows the host entered one; it doesn't confirm the permit is valid.

How much does an Airbnb make in Napa?

The average Napa listing earned $45,000 in the 12 months to September 2026, according to AirROI, averaged across every active listing including those booked for only part of the year. The Napa Airbnb market report breaks it down by month, property size and neighborhood.

Method

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Napa County frequently asked questions page was read in a browser because the site blocks scripts.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.

Listing figures come from AirROI's tracking of 599 active Napa Airbnb listings over the 12 months to September 2026.
