Your home
Can You Host an Airbnb in Tampa? It Depends on the Home
Whether you can host in Tampa turns on whose home it is and whether you live there.
Your own home, rented whole while you're away
Allowed with conditionsAllowed with a DBPR vacation rental license when stays are seven nights or longer. Under the city zoning code, shorter stays in a single-family neighborhood are a violation that draws code enforcement fines. You also need a city business tax receipt and tax registrations, and renting a homestead can end the homestead exemption.6,9,11,18,19
A second home or investment property
Allowed with conditionsAllowed with a DBPR license, a city business tax receipt and the tourist tax account, with stays of seven nights or longer in single-family districts. Tampa has no owner-occupancy requirement: the zoning definition covers a home rented on a weekly or longer basis.9,11,18,19
A condo or a home in an HOA
Allowed with conditionsAllowed unless the association's documents restrict it. A condominium amendment that bans renting binds only owners who consent or who buy afterward, but a homeowners' association can amend its documents to restrict rentals under six months, or more than three a year, for all owners.7,8
A home outside Tampa city limits (unincorporated Hillsborough County)
Allowed with conditionsCity of Tampa zoning does not apply. The state license, taxes and Hillsborough County rules do, including the county's $200-a-year registration from January 1, 2027. The City's business tax page offers an address check to see whether a property is within Tampa city limits.20,22,24,26
Permit
Do You Need a Permit for Airbnb in Tampa?
Yes. Short-term rental hosts in Tampa need the Florida vacation rental license from the Florida Department of Business and Professional Regulation (DBPR), Division of Hotels and Restaurants. It costs $230 in the first year ($230 the first year ($50 application + $10 education fee + $170 license) and $180 a year to renew ($10 + $170) for one rental unit; a city business tax receipt is separate.) and $180 a year to renew.3,11,12
- Who needs it
- Anyone renting a whole house, condo or unit in Tampa more than three times in a calendar year for stays under 30 days. The City of Tampa has no separate short-term rental permit; renting only a room does not need the state license.3,11,12
- Issued by
- Florida Department of Business and Professional Regulation (DBPR), Division of Hotels and Restaurants
- Valid for
- The license is renewed every year on February 1, the renewal date for the DBPR district that includes Hillsborough County.
- Processing
- Online applications are usually processed in one to two business days.
Fees
| Fee | Amount |
|---|---|
| Application (new license)Paid on a new application, in addition to the license fee. | $50 |
| Hospitality Education Program feePaid on the new application and on every renewal. | $10 |
| License fee, single rental unitFull-year fee for one unit; $90 if applying within six months of the February 1 renewal date. | $170 |
Who qualifies
- Vacation Rental - Dwelling: a single-family house, townhouse, or a unit in a duplex, triplex, quadruplex or other building with four or fewer units.
- Vacation Rental - Condominium: a unit in a condominium or cooperative.
- City zoning: a Tampa dwelling unit is a home rented for owner occupancy or on a weekly or longer basis, so stays of under seven nights are not permitted in single-family residential districts.
- Condo and homeowners' association documents can restrict or ban rentals.
- Hillsborough is in the DBPR district that renews on February 1; all units on one license must be in the same district.
How to apply
- Create a DBPR online services account and apply for Vacation Rental (Dwelling) or Vacation Rental (Condominium), giving the address of the rental.
- Pay the $50 application fee, the $10 education fee and the $170 license fee.
- Display the license in a conspicuous place on the premises.
- Register with the Florida Department of Revenue for the sales tax on transient rentals, and open a tourist development tax account with the Hillsborough County Tax Collector for bookings Airbnb does not collect.
- Obtain a City of Tampa business tax receipt for the rental.
Applications go through the official application page .
Permit rules
- Whole-home rentals need a DBPR vacation rental license
- Each public lodging establishment, including a vacation rental, must obtain a license from DBPR. The license cannot be transferred from one place or person to another.3,11 Applies to: entire homes, condos and units rented more than three times a year for under 30 days
- Three rentals a year triggers the license
- DBPR says you need the license if you rent an entire unit more than three times in a calendar year for short stays, or if it is advertised as regularly rented to guests.11 Applies to: entire units
- Renting only a room does not need the state license
- Renting a single room or rooms rather than the whole unit is not classed as public lodging, so no DBPR license is needed. City, county or other local rules may still apply.11 Applies to: room rentals in an occupied home
- No City of Tampa short-term rental permit
- Tampa does not issue a short-term rental permit or keep a registry. The city repealed its rental certificate and rental-property registration requirement effective May 4, 2023, and rental owners still pay business tax.19 In force since May 4, 2023
- City business tax receipt for rental owners
- Tampa requires property owners and agents who rent property for gain to hold a City business tax receipt and pay the business tax, which applies to all residential and commercial rental properties.19
- Register with the Department of Revenue for transient rental tax
- Anyone who rents transient accommodations must register with the Florida Department of Revenue to collect, report and remit tax, using the DR-1 application. Florida requires a return to be filed even when no tax is due; returns are due on the 1st and late after the 20th of the month following the reporting period.13
- Hillsborough County registry applies outside city limits from 2027
- Hillsborough County's short-term vacation rental registration ($200 a year, with a local responsible party and code enforcement inspections) takes effect January 1, 2027 in unincorporated areas. The City of Tampa has the option to adopt it.22,23,26 Applies to: homes outside Tampa city limits · Takes effect January 1, 2027
Who can host
Who Can Host an Airbnb in Tampa, and Where
Florida state law applies on top of Tampa's own rules: the Florida short-term rental regulations page covers the state license and what cities and counties can and can't regulate.
- Short-term rentals are not a listed use in single-family districts
- The court reasoned that Tampa's use table lists single-family dwellings and a few other uses in the RS-60 district, bars hotels and motels there, and has no short-term or vacation rental category, so nightly rentals are prohibited in those neighborhoods.18 Applies to: single-family residential districts such as RS-60
- State law limits local rules on how long or how often
- Florida law bars a local law, ordinance or regulation from prohibiting vacation rentals or regulating their duration or frequency, except for rules adopted on or before June 1, 2011. The 2022 Tampa court opinion on the seven-night rule does not discuss this exception.1
- Condo rental bans bind only consenting or later owners
- A condominium amendment that prohibits renting, changes the rental term or limits how often units can be rented applies only to owners who consent and owners who buy after the amendment takes effect. Your condo's declaration as recorded when you bought still controls.7 Applies to: condominium units
- An HOA can restrict rentals under six months, or more than three a year
- A homeowners' association may amend its governing documents to prohibit or regulate rentals for terms under 6 months and to prohibit renting a parcel more than three times a year. Those amendments apply to all parcel owners.8 Applies to: parcels in homeowners' associations
Operating rules
Operating Rules for Tampa Short-Term Rentals
- Dwellings are rented weekly or longer
- Tampa's zoning code defines a dwelling unit as a home used by one family for owner occupancy or for rental on a weekly or longer basis, so a stay of under seven nights is not a dwelling use.9,18 Applies to: dwellings in Tampa zoning districts
- Court upheld the seven-night rule in a single-family district
- In 2022 a circuit appellate panel affirmed a code violation against a South Tampa home rented for two nights in an RS-60 single-family district, holding that the city code prohibits rentals of fewer than seven days there.18 Applies to: single-family residential districts such as RS-60 · In force since October 24, 2022
- No more than four unrelated people in a home
- A Tampa household can be any number of related people or up to four unrelated people living together, so a large unrelated group, such as the university team in the 2022 case, exceeds the limit in a residential district.9,18 Applies to: residential districts
- Enforcement through code enforcement hearings
- Tampa enforces its zoning rules through code enforcement hearings. In the 2022 case the city built its case from neighbors' testimony and the booking platform's reservation records.18
- Nightly rental violations get no time to cure
- The court held that a rental of a few nights is a transient violation that cannot be cured, so the city can go straight to a hearing without giving the owner time to correct it.18
- DBPR inspects licensed vacation rentals
- DBPR inspects each licensed public lodging establishment at least biannually, and at other times it considers necessary. Inspectors record fire safety items and report problems to the State Fire Marshal and local fire authorities.1,11 Applies to: licensed vacation rentals
- Smoke detectors, clean linens and balcony inspections
- Every living unit needs smoke detectors and all units must comply with NFPA 101, the Life Safety Code. Buildings of three or more stories must file a Certificate of Balcony Inspection every three years unless balconies and stairs are condominium common elements.11
- Renting a homestead can end the homestead exemption
- Renting all or substantially all of a home previously claimed as homestead counts as abandoning the homestead until the owner lives there again. Abandonment after January 1 does not affect that year's exemption unless the home is rented for more than 30 days a year for two consecutive years.6 Applies to: homestead-exempt owners renting the whole home
- Hillsborough County tourist tax account
- Owners, managers and operators who rent for six months or less must collect the 6% Hillsborough County tourist development tax and remit it to the County Tax Collector; payments are due monthly and late after the 20th. Airbnb collects it on its own bookings.21,25

What the host still handles
- Florida DBPR vacation rental license for whole-home rentals under 30 consecutive days (renewed each February 1).
- Florida Department of Revenue: register (DR-1, online) to collect, report and remit sales tax on transient rentals, and file a return each period even if no tax is due; confirm with the Department whether an Airbnb-only host still files.
- Hillsborough County Tax Collector: a tourist development tax account for bookings that Airbnb does not collect (direct bookings and other platforms); payments are due monthly on the 1st of the month after collection and late after the 20th.
- City of Tampa business tax receipt for the rental property.5,13,14,15,16,21,25
Fines
How to Avoid Airbnb Fines in Tampa
Fines in Tampa fall on hosting without the Florida vacation rental license, or outside the rules above. With it in hand and the rules followed, none of the fines below apply.
- City code fines for a zoning violation such as a nightly rental in a single-family district: up to $1,000 per day for a first violation and up to $5,000 per day for a repeat violation.10
- In the 2022 case a special magistrate fined the owner $10,000 for a two-night rental; the court upheld the violation but quashed the fine because it was set in the wrong category and sent it back for a new amount.18

- DBPR may fine a licensee up to $1,000 per offense and can suspend, revoke or refuse a license.4

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The City of Tampa Code of Ordinances on Municode was read in a browser; the Hillsborough County ordinance text was not yet published, so the county's meeting recaps and Business Impact Estimate were used.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 4,480 active Tampa Airbnb listings over the 12 months to September 2026.
