Is Airbnb Legal in Detroit? 2026 Rules, Permits & Taxes
On paper, no: Detroit's zoning code prohibits paid overnight guests in homes and the city issues no Airbnb permit. In practice, news reports say the ban has not been enforced against hosts, and a draft ordinance to regulate them has not been adopted; hosting without a license still risks a zoning fine. A bed and breakfast inn outside the R1 and R2 districts is the licensed route.1,9,11,12,14,16,17

The short answer
Detroit Airbnb Rules in Brief
- Paid overnight guests are prohibited as a home occupation (zoning code Sec. 50-12-492(d), in force since February 6, 2018), and the city issues no short-term rental permit; news reports in 2018 and 2025 said the ban was not being enforced against hosts.
- A bed and breakfast inn is the lawful alternative: the owner or manager lives on site, up to ten bedrooms, a BSEED business license ($223 fee) and conditional-use approval in most districts outside R1 and R2.
- Airbnb collects the 6% Michigan use tax; no Detroit city lodging tax applies.
- A proposed city short-term rental ordinance has not been adopted, and a 2026 state bill (House Bill 6027) would clarify the rule against total bans.

Your home
Can You Host an Airbnb in Detroit? It Depends on the Home
Whether you can host in Detroit turns on whose home it is and whether you live there.
Your own home, rented whole while you're away
UnsettledDetroit's zoning code prohibits using a dwelling for paid overnight guests as a home occupation, and no short-term rental permit exists. The only lodging route is a licensed bed and breakfast inn, which must be the residence of an owner or manager who lives on site. The city has not enforced the ban against hosts, news reports say; hosting without a license still risks a zoning fine.1,7,16,17
A room in your home with you present
Allowed with conditionsOnly as a licensed bed and breakfast inn in a district that allows one (the use table leaves R1 and R2 blank): conditional-use approval where the table shows a C, a BSEED business license ($223), the owner or manager on site and no more than ten bedrooms. Elsewhere, paid overnight guests are prohibited as a home occupation.1,7,11
A second home or investment property you don't live in
UnsettledShort stays are prohibited, and a bed and breakfast inn must be the residence of its owner or manager. Leasing the property to a tenant is the lawful route: register it with BSEED and obtain a Certificate of Compliance. The city has not enforced the ban against hosts, news reports say; hosting without a license still risks a zoning fine.1,7,10,16,17
A rented apartment (tenant hosting)
UnsettledThe prohibition on paid overnight guests applies to any dwelling, so a tenant cannot host Airbnb stays; a bed and breakfast inn must be the residence of an owner or manager. The city has not enforced the ban against hosts, news reports say; hosting without a license still risks a zoning fine.1,7,16,17
Permit
Do You Need a Permit for Airbnb in Detroit?
Yes. Short-term rental hosts in Detroit need the Bed and breakfast inn business license; no short-term rental permit exists from Buildings, Safety Engineering and Environmental Department (BSEED), Business License Center. It costs $223.1,9,11,12,14,16,17
- Who needs it
- Anyone running a bed and breakfast inn. An ordinary Airbnb-style rental of a dwelling cannot be licensed, because Detroit issues no short-term rental permit.1,9,11,12,14
- Issued by
- Buildings, Safety Engineering and Environmental Department (BSEED), Business License Center
- Valid for
- Business licenses are issued by BSEED and renewed on a cycle set by license type.
- Platform checks
- Airbnb leaves permits to the host: its help page tells hosts to look up the permitting and zoning rules that apply where the property stands.
Fees
| Fee | Amount |
|---|---|
| Bed and breakfast inn business licenseBSEED business license fee, listed in the fee schedule as Rooming House Bed & Breakfast. | $223 |
Who qualifies
- The inn must be mainly the residence of an owner or manager who operates and lives in the building
- No more than ten bedrooms for transient guests; no guest room in a basement or cellar
- Zoning must allow it: the use table shows a conditional use in the R3, R4, R5, R6, B1, B2, B4 and SD1 districts and a use by right in the MKT district, and leaves R1 and R2 blank
- Lodging licenses need clearances from Environmental Health, Fire, Property maintenance and Treasury
How to apply
- Confirm the property's zoning district allows a bed and breakfast inn in the use table (Sec. 50-12-65), which leaves R1 and R2 blank.
- Where the table shows a conditional use, obtain conditional-use approval under the Article III, Division 7 procedure.
- Apply for the lodging business license through BSEED's online business licensing process (Accela) and obtain the Environmental Health, Fire, Property maintenance and Treasury clearances.
- Meet the operating standards in Sec. 50-12-216, including smoke detectors, a fire extinguisher on each floor and two exits.
Applications go through the official application page .
Permit rules
- Council staff: short-term rentals are prohibited
- The City Council Legislative Policy Division reported on June 24, 2025 that the code was expected to be amended but that, currently, short-term rentals in the city are prohibited. No short-term rental permit is available.7 In force since June 24, 2025

- Rental registration is free
- The Certificate of Rental Registration for a leased property is free of charge; the owner submits a registration form to BSEED.10 Applies to: Long-term rentals
- No statewide license
- Michigan has no statewide short-term rental license or registry; the Legislature has considered such bills for several years without enacting them, so Detroit's own zoning code governs.7
- Airbnb leaves local permits to the host
- Airbnb tells hosts to look up the permitting, zoning, safety and health rules that apply where the property stands.14
Who can host
Who Can Host an Airbnb in Detroit, and Where
Michigan state law applies on top of Detroit's own rules: the Michigan short-term rental regulations page covers the state license and what cities and counties can and can't regulate.
- Paid overnight guests prohibited in a dwelling
- The zoning code prohibits using a dwelling to accommodate paid overnight guests as a home occupation, which rules out ordinary Airbnb hosting in a home. The prohibition took effect on February 6, 2018.1,7 In force since February 6, 2018
- Home occupations are allowed unless the code prohibits them
- Detroit allows home occupations that meet the code's performance standards unless Section 50-12-492 specifically prohibits them, and paid overnight guests are on that prohibited list.1,7
- Bed and breakfast inns are the exception
- The code permits public accommodations, including bed and breakfast inns outside the R1 and R2 districts, as provided in Section 50-12-65. A host who wants paid overnight guests in Detroit has to qualify as one of these uses.1,7 In force since February 6, 2018
- Bed and breakfast inns: where zoning allows them
- The use table shows a bed and breakfast inn as a conditional use in the R3, R4, R5, R6, B1, B2, B4 and SD1 districts and as a use by right in the MKT district. The R1 and R2 cells are blank, and a blank cell means the use is not allowed in that district unless another rule allows it.1 Applies to: Bed and breakfast inns
- Bed and breakfast inn: owner or manager lives on site
- The primary use of a bed and breakfast inn must be as the residence of the owner or manager who operates and occupies the building, with up to ten bedrooms for transient guests.1 Applies to: Bed and breakfast inns
Operating rules
Operating Rules for Detroit Short-Term Rentals

- A city lodging tax would need voter approval
- Council staff reported that Detroit could adopt a lodging excise tax of up to 2%, but only after voters approve it, and that the home occupation prohibition would first have to be removed to tax homeowners who host.7 In force since June 24, 2025
- Fines for an unlawful land use
- A violation of the zoning chapter is a blight violation. For land use without a permit, the fine is $250, $500 and $1,000 for a first, second and third-or-later offense as an "other unlawful land use", and $2,500, $5,000 and $7,500 for an unlawful change of use of a building or land. What the host still handles
Fines
What Are the Airbnb Fines in Detroit, and Are They Enforced?
No published case shows Detroit fining a host, and news reports in 2018 and 2025 said the city was not enforcing the ban. The zoning code still sets the fines below, so hosting without a license carries this risk until the rules change.2,16,17
- Using land or a building for a use the zoning code does not allow is a blight violation, fined under Sec. 50-5-28 of the zoning code: $250 for a first offense, $500 for a second and $1,000 for a third and later offense as an "other unlawful land use", and $2,500, $5,000 and $7,500 for an unlawful change of use of a building or land. Each day a violation stays uncorrected after notice counts as a separate violation.2
- Paying a civil fine before the appearance date cuts it by 10 percent; paying after the appearance date adds 10 percent.2
- Rental property operated without registration is a blight violation (a blight ticket); BSEED enforces these and issues higher fines for repeat violations.10

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Detroit zoning code on Municode (Articles V and XII) was read in a browser; the City Council Legislative Policy Division memo quotes the same Sec. 50-12-492(d) wording and is readable by script. Fine amounts come from Sec. 50-5-28 of the code as amended March 8, 2023.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 1,240 active Detroit Airbnb listings over the 12 months to September 2026.
