Who qualifies

  • The local health officer or sanitarian in the county validates the application and inspects the home before the state issues the license
  • New construction or a remodel needs plan review approval and a pre-opening inspection first
  • A change of owner or operator needs a new license application
  • Many cities also require their own short-term rental permit, zoning approval and fire inspection (Whitefish, Bozeman, Missoula, Billings, Kalispell, Livingston, Columbia Falls)

How to apply

  1. Check the zoning and any city or county short-term rental permit for the property before applying.
  2. Contact the county or city-county health department for the plan review and license application; the state does not accept applications directly from hosts.
  3. Pass the health department inspection (and any city fire inspection) and pay the license fee; the local health officer or sanitarian validates the application and the state issues the license.
  4. Register with the Montana Department of Revenue for a lodging facility sales and use tax account (a seller's permit) through the TransAction Portal if you take bookings outside Airbnb.
  5. Renew each year before December 31 through the invoice mailed after October 1.

Applications go through the official application page .

FAQ

Montana Short-Term Rental Laws: Frequently Asked Questions

Is Airbnb legal in Montana?

Yes. The state health department lists Airbnb and Vrbo rentals among public accommodations that need an annual license, and state law lets cities regulate them, so permits and zoning depend on the town.4,7,12

Do I need a permit or license for Airbnb in Montana?

Yes: the state public accommodation (tourist home) license, validated by the county health officer or sanitarian. Many cities also require a local permit, including Whitefish, Bozeman, Missoula, Billings, Kalispell, Livingston and Columbia Falls.4,9,19,21,22,24,26,27

How much is the Montana short-term rental license?

$100 a year for up to 10 rooms, $175 for 11 to 25 rooms and $250 above that, with a $25 late fee after December 31. County health departments can add a plan review fee, such as $150 in Ravalli County.5,13,32

Can I rent a home I don't live in?

Sometimes. Bozeman has banned new non-owner-occupied rentals since December 14, 2023, and Whitefish allows rentals only in five zoning districts, while Missoula, Billings, Kalispell and Livingston issue permits for homes where the host does not live.9,19,21,22,24,26

Does Airbnb collect hotel or lodging tax in Montana?

Yes for the state tax: Airbnb collects the 4% lodging facility use tax and the 4% lodging sales tax on stays of 29 days or shorter, and the 4% Big Sky resort tax. Hosts remit the Whitefish and Columbia Falls resort taxes themselves.19,28,33

What is the total lodging tax on an Airbnb stay in Montana?

8% statewide (4% use plus 4% sales). Resort tax raises it to 11% in Whitefish and Columbia Falls (3%) and 12% in Big Sky (4%).11,17,20,29

What is the fine for an illegal short-term rental in Montana?

State law sets a civil penalty of up to $500. Whitefish fines $300 for a first violation and $500 for each later one, Billings fines $300 and up to $500 for each additional day, and Bozeman treats an unregistered rental as a misdemeanor.6,8,21,24

Is there a limit on how many nights I can host?

The state license and lodging tax turn on stays under 30 nights rather than a yearly cap. Limits come from cities, such as Bozeman's rule that new hosts live in the home 70% of the year.11,21

Can my city restrict short-term rentals?

Yes. State law recognizes that municipalities may regulate them, and Whitefish allows rentals only in five zoning districts. In Gallatin County, a zoned district that does not mention rentals does not allow them.7,16,19

Do I need to register with the Montana Department of Revenue?

Each lodging accommodation that must collect the tax applies for a seller's permit. Kalispell does not ask for extra documents if a host books only through Airbnb, but Bozeman wants the Department of Revenue account number on the city permit, and bookings outside Airbnb are the host's to tax.11,21,26

Do I need to show a permit number on my Airbnb listing?

Where a city issues one, yes. Whitefish requires its registration number on any listing, Bozeman requires platforms to list the active permit number, and Missoula requires platforms to collect and confirm its registration number.8,21,22

Are property taxes higher for short-term rentals in Montana?

Yes. For tax year 2026 short-term rentals and second homes pay a flat 1.90% of market value, while primary residences and long-term rentals pay tiered rates starting at 0.76%.30

How These Rules Were Checked

Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out. The Bozeman short-term rental page, the Whitefish city code and the FTC fee-rule FAQ were read from Internet Archive copies (September 2026, January 2025 and September 2026); the Bozeman page was also read live in a browser.

Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the state agency and your city or county has the final word on any application.
