- Other cities in the county set their own rules
- Texas law leaves each city free to adopt and enforce an ordinance regulating short-term rental units, so permits, fees and limits differ from one Harris County city to the next.1 Applies to: Cities inside Harris County · In force since June 12, 2025

Who can host
Who Can Host an Airbnb in Harris County, and Where
Texas state law applies on top of Harris County's own rules: the Texas short-term rental regulations page covers the state license and what cities and counties can and can't regulate.
- No county zoning
- Texas counties are not granted zoning powers, so Harris County does not restrict where short-term rentals may operate in its unincorporated area; private deed restrictions and covenants usually govern land use there.9 Applies to: Unincorporated Harris County
- The county can enforce recorded subdivision restrictions
- Counties are authorized to enforce private restrictions recorded for a subdivision, including restrictions on uses, so a recorded covenant that bars rentals or commercial use can be enforced by the county as well as by the HOA.9 Applies to: Unincorporated Harris County
- HOA rules and deed restrictions still apply
- A 2025 state law leaves homeowners' associations and other private parties free to enforce their own rules and deed restrictions, so a subdivision's covenants can limit rentals even where the city and county allow them.1 In force since June 12, 2025
- Silent covenants do not bar short stays
- The Supreme Court of Texas held in 2018 that covenants limiting a lot to residential use, and silent on short stays, did not prohibit short-term rentals, so a host reads the exact wording of the subdivision's deed restrictions.10 In force since May 25, 2018

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
Listing figures come from AirROI's tracking of 58 active Harris County Airbnb listings over the 12 months to October 2026.
