- The application includes the DNS form, the business plan of operation checklist and a floor plan sketch of each dwelling unit
- The home passes the inspection DNS schedules after the license fee is paid
- The operator accepts responsibility for HOA bylaws, covenants, zoning and city ordinances; the city lists no owner-occupancy test
How to apply
- Check that the rental fits: part or all of a home rented for under a month, with no more than 4 units on one license.
- Download the DNS application form and the Business Plan of Operation checklist from the city's Tourist Rooming House page and complete both, with a floor plan sketch of each dwelling unit.
- Email the form and checklist using the link on that page, or mail them to the Department of Neighborhood Services, Environmental Division, 841 N. Broadway, Room 105, Milwaukee, WI 53202.

- Within 30 days of receipt, DNS mails notice of the application to the local council member and to homes within 250 feet.
- Once licensed, post the license on the premises and display it in the Airbnb listing; register for sales tax if you take bookings outside a platform.

Permit rules
- State license, issued through the city
- Milwaukee treats a short-term rental as a tourist rooming house. The state requires a license, and the city's Department of Neighborhood Services (DNS) administers and inspects it as the state's agent.10
- License required above 10 nights a year
- State law requires a tourist rooming house license from the Department of Agriculture, Trade and Consumer Protection for any host who operates a short-term rental more than 10 nights a year; in Milwaukee the city issues it as the state's agent.2,10
- Apply by form, then pay, then inspection
- The host sends the DNS form and the business plan checklist, which needs a floor plan. DNS then sends payment instructions and, once paid, schedules an inspection of the property.10,12
- Permit valid for 12 months
- The city's application form states that the permit is valid for 12 months and that operating requires a permit.11
- The city sets its own license fee
- A local agent of the state has authority to set and collect the fees for the licenses it issues, so Milwaukee's fee is the city's own and not the state's schedule.7
- City form lists $121 and a $300 reinspection fee
- The city's application form lists a total permit fee of $121.00 for a tourist rooming house and a $300.00 reinspection fee.11
- State schedule for licenses the state issues itself
- Where the Department of Agriculture, Trade and Consumer Protection issues the license directly, one home pays $296 a year plus a $592 one-time pre-inspection fee (licenses issued April 1, 2026 through March 31, 2028).7 In force since April 1, 2026
- 30 days to decide once complete
- The state rule gives the department or its agent 30 calendar days to issue or deny a new license after the applicant meets all requirements.6
- Post the license and show it in the listing
- The current license must be posted on the premises where the public can see it, and Airbnb tells Wisconsin hosts to display the license in the listing.6,20
- Citations are reported to the platform
- The issuing city department must report any citation, order or police report tied to a short-term rental to the platforms listing the property within 30 days.1,13 In force since August 20, 2026
- License does not transfer
- A state lodging license cannot be moved to another property or another person, so a buyer of a rental home applies for a new license.3
- Advertised price must be the total price
- Since May 12, 2025 a federal rule requires any advertised price for a short-term rental to show the total price including mandatory fees; taxes and other government charges may be shown separately.9 In force since May 12, 2025
Who can host
Who Can Host an Airbnb in Milwaukee, and Where
Wisconsin state law applies on top of Milwaukee's own rules: the Wisconsin short-term rental regulations page covers the state license and what cities and counties can and can't regulate.
- A room or a whole home both count
- Renting part or all of a residence to visitors for under a month falls under the tourist rooming house license, so the rule covers a spare room as well as a whole home.10
- Up to 4 units per license
- One tourist rooming house license covers as many as 4 rentable units such as rooms, cottages or cabins; a property renting 5 or more units needs a hotel license.11
- No ban on stays of 7 nights or more
- Milwaukee cannot prohibit renting a residential dwelling for 7 consecutive days or longer, so stays of a week or more are allowed in every residential area.2
Operating rules
Operating Rules for Milwaukee Short-Term Rentals
- No night cap in Milwaukee
- State law lets a city cap rentals of 7 to 29 nights at no fewer than 180 days in any 365-day period. Milwaukee's short-term rental ordinance, section 105-80, sets no night cap.1,2
- Inspection before the first license
- The department or its agent, here DNS, must inspect the home before the first license is issued.6,10
- Smoke and carbon monoxide alarms
- Each rental unit needs smoke alarms, and a carbon monoxide alarm is required in a unit with a fuel-burning appliance. The city's business plan asks the host to list the number and location of each.8,12
- Neighbors within 250 feet are notified
- Within 30 days of receiving a tourist rooming house application, DNS mails written notice to the local council member and to every residence within 250 feet of the property. The rule took effect on August 20, 2026.1,13 In force since August 20, 2026
- Public list of licensed rentals
- DNS must keep a publicly available list of short-term rental properties in the city, and its Tourist Rooming House page links a list of active rentals that is updated monthly.1,10 In force since August 20, 2026
- Guest numbers follow the zoning district
- The business plan states that maximum tourist occupancy must comply with the family occupancy rules of the home's zoning district.12
- Noise and litter plan on the application
- The business plan asks how the host keeps the grounds clean and how noise is prevented or handled, along with security and parking arrangements.12
- Liability insurance is asked about
- The business plan form asks whether the rental carries liability insurance.12

How These Rules Were Checked
Each rule on this page was checked in October 2026 against the official source cited beside it: the ordinance or statute, the permit office's own pages and the tax authority. Airbnb's help pages are cited on their own only for what Airbnb itself does, such as the taxes it collects and the permit checks it runs, and otherwise only beside an official source; news reports only for when a change was announced. Rules that could not be confirmed on an official page are left out.
Rules change with council votes, court rulings and new state laws, so the page is rechecked every three months and whenever a scheduled change takes effect. It summarizes the rules for information and is not legal advice; the local authority has the final word on any application.
